Speed Limitation Devices Workshop

Approval is granted to individuals and legal entities when the conditions of approval are fully met. Any application must be accompanied with supporting documentation and relevant information to prove compliance with the conditions of approval. The requirements for approval are prescribed in the Regulation issued in 2002 (P.I. 95/2002 – Κ.Δ.Π. 95/2002). As the criteria for workshop approval are prescriptive, it is strongly recommended that the prospective applicants contact the Department for further advice before proceeding with any expenses.

The criteria for approval are the following:

• Premises: a minimum workshop area of 60 square meters;
• Instrumentation/equipment: The workshop shall have as a minimum the following instruments and/or equipment:
  • An instrument capable for calibrations of speed limitation devices to the satisfaction of the competent authority;
  • A Workshop Inspection lamp;
  • A Multimeter;
  • A Voltmeter.
• The owner of the workshop shall prove that he employs a technician specialized on speed limitation devices, with the following qualification:
  • a university degree in the field of Mechanical or Electrical engineering; or
  • a college diploma in the field of Mechanical or Electrical engineering; or
  • a diploma of Higher Technical Institute of Cyprus in the field of Mechanical or Electrical engineering or other equivalent diploma in the same field; or
  • a certificate of a Technical School in the field of Mechanical or Electrical sector plus a minimum three (3) years of experience in the automotive industry; or
  • a certificate of a Secondary education plus a minimum four (4) years of experience in the automotive industry; or
  • apprenticeship scheme or equivalent program plus a minimum five (5) years of experience in the automotive industry.

In addition to the above, the technician must possess a certificate for a specialized training on speed limitation devices work, which was awarded from a speed limitation devices manufacturer or a vehicle manufacturer of the M3 (max. permissible weight 10 tons) and N3 categories.

The application for Authorisation of Workshop for Installation, Calibration, Maintenance, and Repair of Speed Limitation Devices can be submitted either through the PSC Cyprus, or directly to the Competent Authority, by hand, mail or e-mail, addressed to:

1. The application form should be accompanied by the following documents:

   • Applicants I.D:
     • If the applicant is a self-employed individual, copies of his identity card and evidence of a recent Social Insurance payment (evidence for practicing as a self-employed individual). Additionally, in the case of European Union citizens a Registration Certificate (Form MEU1A) or in the case of Non-European Union Nationals a Temporary Residence and Employment Permit, both issued from the Civil Registry and Migration Department;
     • If the applicant is a company:
       • copies of the company Certificate of Incorporation, Shareholders, Directors and Secretary, Registered Office Address, issued by the Department of Registrar of Companies and Official Receiver;
       • copies of the identity card and evidence of a recent Social Insurance payment of at least one employed specialized technician. Additionally, in the case of European Union citizens a Registration Certificate (Form MEU1A), or in case of Non-European Union Third Country Nationals a Temporary Residence and Employment Permit, both issued from the Civil Registry and Migration Department and of a recent Statement of Earnings and Contributions of company staff (Form Y.K.A. 2-002) from the Social Insurance Services as evidence for employment of the specialized technician.
   • Premises:
     • Site plans/dimensioned drawings (preferably of scale 1:100), showing the premises useful area i.e. the proposed inspection/calibration area and any uncovered areas.
   • Instrumentation, tools and manuals:
     • Technical details of the instrument(s), equipment and tools (such as copies of instruction/technical manuals) to be used for the calibrations and a declaration from the manufacturer of the workshop’s capability to calibrate speed limitation devices installed on vehicles of the M3 (max. permissible weight 10 tons), or N3 categories.
   • Workshop Technician qualifications:
     • Copy of degree, diploma, etc as evidence of the applicant qualifications and proof of relevant experience;
     • Evidence of relevant experience (Detailed statement of insurer’s earnings, or a certificate for the insurer’s account or insured at the Social Insurance Scheme (Form Y.K.A. B-10));
     • Copy of a certificate for specialized training on speed limitation devices or a declaration from the training provider.

    

There are no fees applicable.

Administrative Action against a Competent Authority’s Decision

Any person may file an Administrative Action at the Administrative Court against a decision, act, or omission of any competent authority or body.

Pursuant to Article 146 of the Constitution, an Administrative Action may be lodged within 75 days from the date of the decision or act or omission or from the day when such decision or act or omission was notified to the applicant.

The Administrative Court acts as a cassation Court and not as a substantive Court. In other words, the Administrative Court may:
I. Dismiss the Administrative Action
II. Annul wholly or partially the contested decision or act
III. Compel the relevant authority or body to take a certain action

After a decision is annulled, the authority and/or public body must reverse things back to the state prior to when the concerned decision and/or act was executed and reexamine.

An Appeal may be filed against the Administrative Court’s first-instance decision within a period of 42 days from the date such a decision was given.

At the Supreme Court (Court of Appeal Section) hearing, the contested issue of the appeal remains the legality of the decision or act already adjudicated. However, such a revision of the legality of the decision or act is solely examined on the matters and the extent that the two parties have limited the reasons in the relevant notice of appeal.

The decision adopted by the Supreme Court is considered final in relation to the matter that has been judged.

Approved speed limitation devices workshops are obliged to comply with the provisions of the Regulation 95/2002 and among others to:

• Keep a registry of all installations, calibrations, testing and inspections on vehicles for five (5) years; and
• Keep a registry with the vehicles details, the date, approval number, speed limiter type and serial number, set speed and a description of the executed work, the seals, etc.;
• Keep at the workshop only one Seal marking device incorporating the identification mark allocated to the workshop by the EMS Department, which shall be stored in safe place.

The Department of Electrical and Mechanical Services supervises the licensed speed limitation devices workshops in order to ensure compliance with the provisions of the relevant Laws and Regulations and the terms of the license.
