Technical Inspection Centre for Vehicles

Every physical person or legal entity is eligible to obtain the licence for the operation of private technical inspection centres for vehicles, provided that the Department of Road Transport is satisfied that the following criteria are met:

• availability of independent and autonomous premises for the establishment and operation of the private technical control centre for vehicles;
• the town planning permit, the building permit and any other relevant permit related to the premises and/or equipment has been obtained;
• possession of electronic data processing system compatible to that of the Department of Road Transport;
• installation of control lines and the required equipment (see related documents);
• adequate and suitable recruitment of human resources;
• control Accredited Body based on CYS EN ISO IEC 17020 standard or possession of control system recorded within a control manual, that describes the system’s structure as per the quality and covers the general requirements for quality, as well as the special quality procedures, related to all actions to be undertaken for the vehicles’ control.

The application for licence of the operation of the Private Technical Inspection Centres for Vehicles can be submitted either through the PSC Cyprus or by contacting directly the competent authority:

1. The application should be accompanied by the following documents:

   • copy of diploma of the personnel and evidence of relevant experience in automotive engineering, certificate of success to the special examinations of the person in charge of the technical control;
   • copy of architectural plans of the premises;
   • copy of list of equipment and equipment’s arrangement within the premises;
   • copy of building permission;
   • copy of town planning permission;
   • copy of Certificate of Factory Registration from the Department of Labour Inspection;
   • copy of Certificate of Incorporation, Certificate of Shareholders, Certificate of Directors and Secretary (in case of legal person);
   • copy of Certificate of Accreditation as a Control Body based on the standards CYS EN ISO IEC 17020 or evidence that the requirements set out in eligibility criteria section are met;
   • Certificate of Registration to the Registry of Technical Control Line Managers for Vehicles;
     application fee of €170,86 (payable either by cash, cheque, visa card, or bank transfer).

   On site inspections are carried out in order to ensure that all the prerequisites, mentioned under “eligibility criteria” section are met

The application fee is €170,86 and is payable either by cash, cheque, credit card, or bank transfer.

Upon approval, the applicant needs to pay to the Department of Road Transport the licence fee of €854,30 (payable either by cash, cheque, credit card, or bank transfer.

Administrative Action Against a Competent Authority’s Decision

Any person may file an Administrative Action at the Administrative court against a decision, act or omission of any competent authority or body.

Pursuant to Article 146 of the Constitution, an Administrative Action may be lodged within 75 days from the date of the decision or act or omission or from the day when such decision or act or omission was notified to the applicant.

The Administrative Court acts as a cassation Court and not as a substantive Court. In other words, the Administrative Court may:
I. Dismiss the Administrative Action
II. Annul wholly or partially the contested decision or act
III. Compel the relevant authority or body to take a certain action

After a decision is annulled, the authority and/or public body must reverse things back to the state prior to when the concerned decision and/or act was executed and reexamine.

Appeal Information

An Appeal may be filed against the Administrative Court’s first-instance decision within a period of 42 days from the date such a decision was given.

At the Supreme Court (Court of Appeal Section) hearing, the contested issue of the appeal remains the legality of the decision or act already adjudicated. However, such a revision of the legality of the decision or act is solely examined on the matters and the extent that the two parties have limited the reasons in the relevant notice of appeal.

The decision adopted by the Supreme Court is considered final in relation to the matter that has been judged.

Licensed Private Technical Inspection Centres for Vehicles are obliged to comply with the provisions of the Motor Vehicles (Technical Inspection and Technical Inspection Centres) Law of 2007, as periodically amended, and specifically, among others, with the following:

• the licence should be posted in a conspicuous place along with a directory with the names of each Technical Inspection Line Managers for Vehicles employed within the Private Technical Inspection Inspection for Vehicles;
• informs the Department of Road Transport regarding each Technical Inspection Line Managers for Vehicles that has been recruited, fired or has left the private technical inspection centre;
• the technical control for vehicles is performed by the Technical Inspection Line Managers for Vehicles according to the terms and conditions listed on the certificate of registration.

The Department of Road Transport supervises the operation of the Licensed Private Technical Inspection Centres for Vehicles in order to ensure compliance with the provisions of the relevant Laws, Regulations and the terms of the licence.
